Danish man given deferred prison term for posting nude film clips on the social platform Reddit

A Denmark-based citizen has been convicted of uploading sexually explicit segments from copyrighted films and television shows on the social media site Reddit.

Based on a police report obtained by media outlets, the anonymous man shared 347 clips of explicit content in a subreddit he moderated, which were then watched 4.2 million times.

The country's authorities state he has been handed a seven-month deferred sentence for copyright infringement.

Experts explain the man was prosecuted under a seldom-invoked provision in Danish intellectual property legislation, with the court ruling that by removing the footage out of their original context, the man had harmed the performers' "ethical entitlements".

He has also been convicted of distributing more than 25 terabytes of protected data.

From March 2022 to mid-2023, the user using the alias "KlammereFyr" on Reddit uploaded adult clips featuring over 100 actresses.

He distributed them in the forum he was a administrator of.

According to the Denmark's copyright protection organization The Rights Alliance (TRA), his subreddit had more than 6,000 subscribers and participants were prompted to request excerpts of specific actors.

In 2023, campaigners reported the case to the police on behalf of the impacted artists, filmmakers and producers, which resulted in the subreddit being closed down.

One actress, one of the actresses whose explicit content were circulated in the community, explained to Danish media at the period she felt there was a distinction between appearing naked in a film and being shown on Reddit.

The actress stated the posts amounted to "abuse".

'A significant signal'

The man was arrested in fall 2024 and pleaded guilty to the charges recently.

In a comment following the ruling, TRA head Maria Fredenslund remarked the decision sent an "significant" signal "indicating infringements of creators' rights has repercussions".

The ruling is considered unique in the country for its application of the "ethical protections" clause of the Danish Copyright Act, which states an creator's work cannot be used in a manner which violates their reputation.

Intellectual property specialist Dr Alina Trapova told the media the legal matter was "rare" for its emphasis on the harm to the integrity of an artist, rather than to them financially.

The extent to which the ruling could influence nations abroad is uncertain.

But she said there may be "more and more of such cases" in the coming years with the advancement of artificial intelligence, where "the sanctity of one's work might be tempered with with greater ease".
