Alina Habba has left her position as the US Attorney for New Jersey. This decision was prompted by a judicial decision that questioned her right to hold the office.
The nation's top law enforcement official, Pam Bondi, announced the prosecutor's departure on the start of the week. In a statement that the court's "flawed" ruling made it unworkable for her to perform her duties.
"But do not mistake following the order as giving up," she declared. "The effort will now extend throughout the nation."
Habba's exit was triggered by a federal appellate panel found that she had been unlawfully serving as the federal prosecutor. This ruling is could influence numerous criminal cases in New Jersey.
The appellate judges ruled that a temporary posting that did not receive the advice and consent of the Senate violated the federal law governing appointments.
The Attorney General added that the former prosecutor will continue working within the Department of Justice as a senior adviser. Habba plans to seek further review of the disqualification, in the hope of achieving a overturned decision.
On a social media platform, she wrote that judges "cannot be permitted to second-guess the appointment of attorneys tasked with executing the fundamental role of the presidency of enforcing the law."
She praised the prosecutor's work and said that while she was in charge, the state capital of Newark saw a one-fifth decrease in criminal activity. She also stated that the city of Camden experienced its first summer in 50 years with no murders.
Habba, 41, originally became part of Donald Trump's lawyers in 2021. She went on to defended the former president in his business records case in New York last year, which resulted in his guilty verdict on dozens of charges of falsifying business records.
